1. Introduction

These Terms of Service ("Terms") govern your use of the Mali platform, operated by Mali Financial Technologies Ltd ("Mali", "we", "us", or "our"), a company registered in Kenya and licensed by the Capital Markets Authority (CMA) of Kenya. By creating an account or using our services, you agree to be bound by these Terms.

2. Eligibility

To use Mali, you must:

  • Be at least 18 years of age
  • Be a resident of Kenya or an approved jurisdiction
  • Complete our Know Your Customer (KYC) verification process
  • Not be subject to any legal restriction that would prevent you from investing
  • Agree that investments are made with funds you can afford to lose

3. Platform Services

Mali provides a technology platform that facilitates investments in small and medium enterprises (SMEs) through fractional ownership. Mali is not a financial advisor and nothing on the platform constitutes financial advice. All investment decisions are made by you at your own risk.

Mali acts as an intermediary. We conduct due diligence on listed businesses but cannot guarantee the accuracy of all information provided by business owners. You should independently assess all investments before committing capital.

4. Investment Risk

All investments carry risk. You may lose some or all of the capital you invest. Past performance is not indicative of future results. SME investments are illiquid and there is no guarantee you will be able to exit your position on the secondary market at a price you find acceptable.

5. Wallet and Funds

Client funds deposited into your Mali wallet are held in segregated trust accounts, separate from Mali's own operating funds. Deposits are made via M-Pesa, bank transfer, or card. Withdrawals are processed to verified M-Pesa accounts within 1-3 business days.

6. Fees

Mali charges a platform fee of 2% on investment returns and a 0.5% transaction fee on secondary market trades. Deposit and withdrawal fees may apply depending on your payment method. All fees are disclosed at the time of transaction.

7. Account Termination

We reserve the right to suspend or terminate accounts for fraud, violation of these Terms, suspected money laundering, or any other reason at our discretion. In such cases, we will return any available wallet balance to your verified account, less any outstanding fees.

8. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya. Mali is regulated by the Capital Markets Authority of Kenya.
